Making the Law Explicit: The Normativity of Legal Argumentation

Matthias Klatt

Making the Law Explicit: The Normativity of Legal Argumentation

Legal argumentation consists in the interpretation of texts. Therefore, it has a natural connection to the philosophy of language. Central issues of this connection, however, lack a clear answer. For instance, how much freedom do judges have in applying the law? How are the literal and the purposive approaches related to one another? How can we distinguish between applying the law and making the law? This book provides answers by means of a complex and detailed theory of literal meaning. A new legal method is introduced, namely the further development of the law. It is so far unknown in Anglo-American jurisprudence, but it is shown that this new method helps in solving some of the most crucial puzzles in jurisprudence. At its centre the book addresses legal indeterminism and refutes linguistic-philosophical reasons for indeterminacy. It spells out the normative character of interpretation as emphasized by Raz and, with the help of Robert Brandom's normative pragmatics, it is shown...
General Theory of Law And State

Hans Kelsen

General Theory of Law And State

Reprint of the first edition. This classic work by the important Austrian jurist is the fullest exposition of his enormously influential pure theory of law, which includes a theory of the state. It also has an extensive appendix that discusses the pure thory in comparison with the law of nature, positivism, historical natural law, metaphysical dualism and scientific-critical philosophy. "The scope of the work is truly universal. It never loses itself in vague generalities or in unconnected fragments of thught. On the contrary, precision in the formulation of details and rigorous system are characteristic features of the exposition: only a mind fully concentrated upon that logical structure can possibly follow Kelsen's penetrating analysis. Such a mind wil not shrink from the effort necessary for acquainting itself with...the pure theory of law in its more general aspects, and will then pass over to the theory of the state which ends up with a carefully worked out theory of...
A Many-Colored Glass: Reflections on the Place of Life in the Universe (Page-Barbour Lectures)

Freeman J. Dyson

A Many-Colored Glass: Reflections on the Place of Life in the Universe (Page-Barbour Lectures)

"A Many-Colored Glass" does not attempt to bring together all of the celebrated physicist's thoughts on science and technology into a unified theory. The emphasis is, instead, on the myriad ways in which the universe presents itself to us - and how, as observers and participants in its processes, we respond to it. Taken from Freeman Dyson's recent public lectures - delivered to audiences with no specialized knowledge in hard sciences - the book begins with a consideration of the practical and political questions surrounding biotechnology. As he seeks how best to explain the place of life in the universe, Dyson then moves from the ethical to the purely scientific. The book concludes with an attempt to understand the implications of biology for philosophy and religion.

Preface to Plato

Eric Havelock

Preface to Plato

Plato's frontal attack on poetry has always been a problem for sympathetic students, who have often minimized or avoided it. Beginning with the premise that the attack must be taken seriously, Mr. Havelock shows that Plato's hostility is explained by thecontinued domination of the poetic tradition in contemporary Greek thought. The reason for the dominance of this tradition was technological. In a nonliterate culture, stored experience necessary to cultural stability had to be preserved as poetryin order to be memorized. Plato attacks poets, particularly Homer, as the sole source of Greek moral and technical instruction--Mr. Havelock shows how the Illiad acted as an oral encyclopedia. Under the label of mimesis, Plato condemns the poetic processof emotional identification and the necessity of presenting content as a series of specific images in a continued narrative. The second part of the book discusses the Platonic Forms as an aspect of an increasingly rational...

Good Value: Reflections on Money, Morality and an Uncertain World

How should we create wealth in societies, and why is it right and necessary to do so? What improves the lives of the largest number of people? And how do we, living in a globalized world caught in an age of financial and ecological turbulence, respond to the differing needs of individuals and institutions? In "Good Value: Reflections on Money, Morality and an Uncertain World"Stephen Green, Chairman of HSBC, reflects on how the human desires for exploration and exchange have led us into a globalized, urban world. He considers why capitalism - flawed though it obviously is - seems to be the best system by which to improve material human wealth. As the world's financial order is in a state of flux, how do we align these human instincts, and the capitalism they have produced, with our spiritual and psychological needs? And how should the financial sector respond not only to the current crisis but to the wider needs of the people it serves. Do businesses have a duty to society that...

A Short History of the Shadow

609.00 руб.*

Victor I. Stoichita

A Short History of the Shadow

This provocatively "short" history of the shadow opens with a reappraisal of the contribution to the subject that can be teased out from comments by Pliny the Elder and Plato. Pliny's myth of the origin of art, which identifies the birth of artistic representation as having taken place in a Corinth potter's home, and Plato's myth of knowledge, set forth by the philosopher in the celebrated allegory of the cave, both deal with the shadow - the dark spot that by its presence confirms an absence. But the shadow can also be understood to be the present 'other' of the body, a fact enforced by the rule of light, so that the shadow can even be seen to be a form of self-representation. Indeed, according to J.C.Lavatar in the 18th century, it was the shadow of the face, not the face itself, that was the soul's true reflection. Формат: 15,5 см x 23,5 см.
Logic (A Brief Insight)

Graham Priest

Logic (A Brief Insight)

Logic is often perceived as having little to do with the rest of philosophy, and even less to do with real life. In this engaging and accessible introduction, Graham Priest shows how wrong that conception is. He explores the philosophical roots of the subject, explaining how modern formal logic deals with issues ranging from the existence of God and the reality of time to paradoxes of probability and decision theory. Along the way, Priest lays out the basics of formal logic in simple, nontechnical terms.

For and Against Method: Including Lakatos's Lectures on Scientific Method and the Lakatos-Feyerabend Correspondence

The work that helped to determine Paul Feyerabend's fame and notoriety, Against Method, stemmed from Imre Lakatos's challenge: "In 1970 Imre cornered me at a party. 'Paul,' he said, 'you have such strange ideas. Why don't you write them down? I shall write a reply, we publish the whole thing and I promise you—we shall have a lot of fun.' " Although Lakatos died before he could write his reply, For and Against Method reconstructs his original counter-arguments from lectures and correspondence previously unpublished in English, allowing us to enjoy the "fun" two of this century's most eminent philosophers had, matching their wits and ideas on the subject of the scientific method. For and Against Method opens with an imaginary dialogue between Lakatos and Feyerabend, which Matteo Motterlini has constructed, based on their published works, to synthesize their positions and arguments. Part one presents the transcripts of the last lectures on method that Lakatos delivered. Part two,...
